Welcome to our website and thank you for visiting. Listed below are the Terms and Conditions of Use (“Terms”, “TCU”) which apply to the use of www.niomo.co.uk (the “Site”, “Website”) and/or the purchase of goods from this website.
www.niomo.co.uk is an e-commerce service owned and operated by NIOMO Ltd (NIOMO Ltd and www.niomo.co.uk each separately and together in this Agreement, “NIOMO”, “we”, “us” or “our”). NIOMO Ltd is a private limited company registered with Companies House in the UK. The registered Company No is 09306020, with its registered office address at 60 Stanway Street, Studio 12, N1 6RE London, UK.
These Terms and Conditions of Use apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. If you do not agree with these Terms in full, then you may not access this website or use any of its services and we ask you to stop using it immediately.
Every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.
MODIFICATION OF TERMS
Please note that we reserve the right to update or modify these Terms and Conditions of Use at any time without prior notice. Any new features or tools which are added to the current website shall also be subject to these Terms. Your use of our Site following any such changes constitutes your agreement to follow and be bound by these Terms. We therefore encourage you to review the TCU whenever you use this website. If you disagree with any modifications made to the Terms, then please stop using this Site.
ELIGIBILITY TO PURCHASE
The purchase of merchandise through NIOMO Ltd/www.niomo.co.uk is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with English law. By transacting through this site and/or ordering goods you represent that you are entitled to enter into a legally binding contract. Individuals unable to perform legally binding contracts are prohibited from ordering goods using this website. NIOMO holds the right to refuse to process a transaction or order for any reason at any time.
In order to make purchases through the Site, you will be requested to register and provide your personal details. In particular, customers must provide their real name, billing address, shipping address, phone number, email address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide your payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the billing information provided. Our site is only available for use to individuals who meet our terms of eligibility and who have been issued with a valid debit/credit card by a bank acceptable to NIOMO and whose applications are acceptable to NIOMO. We refuse the right to ship multiple items to any one customer or postal address.
You agree to promptly inform us about any changes to your account and any other important information, so that we can complete your transactions and contact you as needed.
PLACING AN ORDER
On making a purchase you agree to the Terms set out on this page.
Before your order can be accepted we must receive full payment for the price of the goods that you order including any charges for additional services (if applicable). Once payment has been received by us we will confirm that your order has been accepted by sending an email to the email address provided in your order form. Our acceptance of your order brings into existence a legally binding contract between us, concluded in London, in the English language and therefore governed by English law.
Unless you cancel your order, acceptance of your order will be met by us sending out a confirmation. Completion of the contract between you and NIOMO will be met when we email you to confirm the goods have been dispatched.
We reserve the right not to accept/cancel your order in the event that we do not obtain authorization for payment; we do not deliver to your area; or that the item ordered is out of stock. We may refuse to process and therefore accept a transaction for any reason, or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from the website at any time, whether or not that particular product has been sold out.
If we decide to cancel your contract we will notify you via email and re-credit your account with the amount deducted as soon as possible. We cannot be held liable or offer any additional compensation for inconvenience.
PRODUCTS OR SERVICES
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. Due to the handmade nature of our pieces there might be small fluctuations in weight and dimensions.
All descriptions of products, product pricing or offers are subject to change at any time without notice, at the sole discretion of us. Furthermore, we reserve the right to modify or discontinue any product or the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or service that we offer and to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.
All of our prices are listed in UK Pounds Sterling as set out on our website and are inclusive of VAT. The total amount of the order including VAT and shipping is displayed in the shopping cart on the checkout page. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit charges may make a difference to the amount billed on your credit card.
Delivery, packaging costs, and/or any other ordered services (if applicable) will be charged in addition. Such additional charges are clearly displayed at the basket page where applicable.
At www.niomo.co.uk, our commitment is to offer beautiful, handmade products at compelling prices every day, with certain limited time offerings of merchandise at promotional prices. While merchandise offered on-line at www.niomo.co.uk will usually be priced the same as merchandise offered at NIOMO stockists, in some cases, NIOMO stockists may have different prices or promotional events at different times.
We accept most major credit/debit cards including Visa, MasterCard, AmericanExpress as well as PayPal and credit cards supported by PayPal. When checking out you will be redirected to a secure checkout via PayPal. Our shopping cart includes an SSL certificate that uses industry standard encryption technology to help us keep your transmitted information safe and secure.
All goods remain property of NIOMO until paid for in full. We reserve the right to refuse any transaction at our discretion. Payments will be debited and cleared from your account upon receipt of your order by NIOMO. If the issuer of your payment card or method refuses to authorise payment to NIOMO, we will not be liable for any delay or non-delivery.
SHIPPING & RETURN POLICY
Most of our jewellery is ‘made to order’ so please allow us 14-21 working days, depending on complexity of the item, to create your unique handmade piece. We aim to dispatch items in stock within 48 hours after receipt of payment, excluding weekends, public or bank holidays. Once your order has been dispatched you will be provided with a tracking number and expected delivery time via email. If you require your items by a specific date or special delivery, please email us at info@localhost and we are happy to help you out!
All orders within the UK are delivered using Royal Mail Special Delivery which means that your items are insured and require a signature upon receipt. It is your responsibility to ensure that the delivery address you give us is correct and accurate. Should the courier or postal service not be able to complete the delivery of your parcel for any reason, it will be your responsibility to cover redelivery costs.
Please note that items purchased from outside the UK and European Union may be subject to import duties, fees and taxes over which we have no control as they are levied by your tax and customs office. As the customer and importer of the goods, you will be responsible for any additional fees and charges. If you are unsure, we recommend that you contact your local customs office prior to purchase. NIOMO is not responsible for any delays on goods that have been held back as a result of procedures carried out by your local custom authorities.
We will do our best to send your purchased goods within the times indicated. However, these delivery times are an estimation and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control. Under no circumstances will we ship any items if we have not received full payment for the price of the goods that you have ordered on the Site.
Your jewellery will arrive in our NIOMO boxes. We use stiff and secure packaging to ensure that your order will arrive in perfect condition. In the unfortunate event that your order arrives in a damaged state please get in touch with info@localhost so we can help.
RETURN POLICY & CANCELLATIONS
As our jewellery is handmade in London and ‘made to order’, NIOMO can only offer a full refund for cancellations made within 24 hours of placing the order. Please email info@localhost.
In any case, we will be happy to exchange unwanted pieces, should you notify us within 7 working days after receipt of your order. To do so, please

We will send you a Return Form via email with your unique Return Number (RN).
Fill in the form and enclose it into the parcel.
Please send all the items and the Return Form packed securely in their original packaging back to this address

Please note that unwanted item(s) have to be returned undamaged, unscratched, unworn and in their original packaging as well as with their security tags still attached. We reserve the right to refuse issuing credit notes for items returned that are not in a resalable condition.
We recommend that the return shipment is sent back to us using a Special Delivery Service. Please provide us with the tracking number and insure the parcel to its appropriate value as the goods are under your responsibility until we receive them. The return shipping cost of your Item(s) is at your own expense. If you have requested an exchange we will only be able to ship your exchanged goods once we have received the returned item(s). You will be charged for any additional cost and any additional shipping, taxes and import duties.
Important note: Earrings are excluded from returns and refunds for hygiene reasons.
If goods are returned in damaged or worn condition, NIOMO reserves the right to deduct the direct costs of recovering the goods from the amount credited to you.
ERRORS, INACCURACIES AND OMISSIONS
The information provided on the www.niomo.co.uk website may occasionally contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing, promotions, offers, product shipping charges, transit times and availability. We apologise for any inconvenience this may cause you. If you are not fully satisfied with your www.niomo.co.uk purchase you may return it. Please see our Return Policy.
In the event one of our products is listed at an incorrect price, NIOMO shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
If you used our contact form or provided your email address during your purchase we might send you our NIOMO newsletter from time to time. Should you wish to unsubscribe please send us an email with the subject ‘unsubscribe” to info@localhost or click the ‘unsubscribe’ link at the bottom of our newsletter.
INTELLECTUAL PROPERTY RIGHTS, COPYRIGHTS, TRADEMARKS & COMMERCIAL USE
You agree and acknowledge that all materials including photographs, images, illustrations, designs, logos, layout, text or script, copyrights, trademarks and all other intellectual property and material rights relating to the content of this Site, including NIOMO software and all HTML, CSS and other code contained in the Sites are part of the Sites and are protected by copyright, trademark and/or other intellectual property rights owned, controlled or licensed to NIOMO and shall remain at all times with the Sites, unless otherwise stated. The contents of the sites as a whole are intended solely for personal, non-commercial use. Such content, including third party trademarks and copyrights displayed or mentioned on the Sites are protected by national or international property and other laws. You are only permitted to use the content as authorised in written by NIOMO. Any reproduction or redistribution of the above listed content is prohibited and may result in civil and criminal penalties.
